If there is a conflict between these general Terms and a separate written contract for engineering services, the separate written contract will take priority for those services.

8. Soothing Sounds

Soothing Sounds is a mindfulness and wellbeing app that allows users to create meditation or relaxation sessions using timers, background music, ambient sound effects, and ending sounds.

Soothing Sounds is provided for general relaxation, mindfulness, and wellbeing purposes only.

It is not intended to provide:

  • medical advice;
  • mental health treatment;
  • psychological therapy;
  • diagnosis;
  • clinical support;
  • emergency support;
  • treatment for any illness, condition, disorder, or injury.

You should not rely on Soothing Sounds as a substitute for professional medical, psychological, psychiatric, therapeutic, or healthcare advice.

If you have a medical or mental health condition, are experiencing distress, or are unsure whether meditation or relaxation exercises are suitable for you, you should seek advice from a qualified professional.

If you believe you may be experiencing a medical or mental health emergency, you should contact emergency services or an appropriate crisis support service immediately.

9. Free and paid features

Some apps may offer both free and paid features.

For Soothing Sounds, the free version may include limitations, such as:

  • advertising;
  • restricted timer duration;
  • disabled free-running mode;
  • disabled audio previews;
  • restrictions on audio playback when the screen is off.

The paid tier may unlock additional features, such as:

  • removal of adverts;
  • full timer range;
  • free-running mode;
  • audio previews;
  • screen-off audio behaviour, subject to device and operating system limitations.

Premium features may vary over time. We may add, remove, modify, or rename features where reasonably necessary, including for technical, legal, commercial, security, or compatibility reasons.

10. Lifetime purchase

Soothing Sounds may offer a one-time lifetime purchase.

A lifetime purchase means that the purchaser receives access to the relevant paid features of Soothing Sounds for the lifetime of that app, subject to these Terms, app store rules, technical compatibility, platform availability, and any lawful changes we may make to the app.

“Lifetime” does not mean:

  • the lifetime of the user;
  • that the app will be available forever on all devices or platforms;
  • that every future Apricot Electronics app will be included;
  • that all future products, services, or separate apps will be provided free of charge;
  • that features will remain unchanged indefinitely.

A lifetime purchase applies only to the app, platform, product, and entitlement described at the point of purchase, unless we state otherwise.

11. Payments, app stores, and refunds

Payments for mobile app purchases may be processed through the relevant app store or platform, such as Google Play.

We do not directly receive or store your full payment card details for purchases made through app stores.

Refunds for paid app features purchased through Google Play or another app store are handled according to the relevant app store’s refund policies and procedures. If you want to request a refund for a purchase made through Google Play, you should request it through Google Play.

Nothing in these Terms limits your statutory consumer rights.

12. Advertising

Free versions of our apps may display adverts.

We are not responsible for the content of adverts provided by third-party advertising networks. Display of an advert does not mean that we endorse the advertised product, service, website, company, or claim.

You should use your own judgement before interacting with adverts or third-party websites.

Paid versions of our apps may remove adverts, subject to successful purchase verification and technical functionality.

14. Engineering services

The Apricot Electronics website may describe engineering, electronics, consultancy, design, development, or related professional services.

Engineering services are provided only under separate written agreement, quotation, statement of work, purchase order, contract, or other agreed terms.

These general website and mobile app Terms do not define the full commercial terms for engineering services.

Our liability in connection with paid app features will not exceed the amount you paid for the relevant app feature, except where the law does not allow such a limitation.

These limitations do not affect your statutory consumer rights.
